Cancellation Policy

(1) Right of Withdrawal for Consumers

If the customer is a natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (consumer), the customer has a right of withdrawal according to § 312g in conjunction with § 355 BGB.

(2) Right of Withdrawal for Purchase Contracts with Wakapapa, brand of K.&N. Schurwoll GmbH for Goods:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the goods. In the case of a contract for multiple goods ordered in a single order and delivered separately, the withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the last good.

In the case of a contract for the delivery of goods in several partial shipments or pieces, the withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the last partial shipment or piece.

In the case of a contract for the regular delivery of goods over a specified period of time, the withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the first good.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not required.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

(3) Exceptions to the Right of Withdrawal

The right of withdrawal against K.&N. Schurwoll GmbH does not apply to the following contracts:

• Contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
• Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You must send back the goods or hand them over to us at K.&N. Schurwoll GmbH, Holzbachstr. 14, 56249 Herschbach, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

The cost of returning the goods within the 14-day period is free of charge for the customer.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
